Missouri Court of Appeals, Eastern District / Sep 15, 2020
State of Missouri, Respondent, vs. John R. Wright, Appellant.
John R. Wright appealed his convictions for second-degree robbery, armed criminal action, and third-degree assault, raising two points of plain error. First, he argued that his Fifth Amendment right against double jeopardy was violated because third-degree assault is a lesser-included offense of second-degree robbery. Second, he contended the trial court erred by not directly answering a jury question about whether fists could be a "dangerous instrument." The Eastern District of Missouri affirmed the judgment, finding no plain error in either point.
