Missouri Court of Appeals, Southern District / Aug 3, 2022

STATE OF MISSOURI, Plaintiff-Respondent vs. JORDAN C. HADEN, Defendant-Appellant

Appellant

Jordan C. Haden appealed his convictions for assault in the second degree of a law enforcement officer and felony resisting arrest. He challenged the sufficiency of the evidence for the felony resisting arrest charge, arguing the arrest was for a misdemeanor DWI, not a felony assault. Haden also contended the trial court erred in finding him a persistent misdemeanor offender, which resulted in court sentencing rather than jury sentencing. The Southern District of Missouri Court of Appeals affirmed the trial court's judgment, denying both points on appeal.
