Missouri Court of Appeals, Eastern District / Aug 22, 2023
Jordan Medlin, Appellant, vs. State of Missouri, Respondent.
Jordan Medlin appealed the denial of her Rule 24.035 amended motion for post-conviction relief without an evidentiary hearing, claiming ineffective assistance of counsel. The appellate court determined that Medlin's amended motion was untimely, which stripped the court of authority to reach the merits of her appeal. Consequently, the court dismissed the appeal for lack of a final judgment and remanded the case for the motion court to adjudicate Medlin's timely pro se motion.
