Joshua Perkins appealed the denial of his Rule 24.035 motion for post-conviction relief, arguing the motion court erred by not conducting an abandonment inquiry and by denying his claim that his guilty plea was involuntary. The appellate court affirmed the motion court's judgment. It held that a timely filed and facially compliant statement in lieu of an amended motion does not necessitate an abandonment inquiry, and Perkins's subsequent pro se amended motion was not a valid "reply" under Rule 24.035(e). The court also found the motion court lacked authority to grant an extension for the amended motion as the deadline had passed.
