Missouri Court of Appeals, Eastern District / Apr 28, 2020
State of Missouri, Respondent, vs. Joshua Jay Johnson, Appellant.
Joshua Johnson appealed the denial of his Rule 29.07(d) motion to withdraw his guilty plea to criminal nonsupport, filed after sentencing. He argued the trial court erred in setting probation payment conditions and revoking probation, and that his plea was involuntary. The Eastern District affirmed, holding that challenges to probation rulings must be brought via extraordinary writ, and challenges to plea voluntariness after sentencing must be brought under Rule 24.035.
