Missouri Court of Appeals, Eastern District / Aug 21, 2018
State of Missouri, Respondent, vs. Joshua K. Armstrong, Appellant.
Joshua K. Armstrong appealed his convictions for multiple counts of attempted statutory rape, statutory sodomy, attempted statutory sodomy, and child molestation. He argued that the verdict directing instructions violated his right to a unanimous jury verdict and that there was insufficient evidence for three of his convictions. The Eastern District affirmed the judgment, finding no plain error in the jury instructions where the victim could not distinguish between repeated, identical acts, and concluding there was sufficient evidence to support the challenged convictions.
