Justin Heller vs. State of Missouri
Justin Heller appealed the denial of his Rule 24.035 motion for post-conviction relief, arguing his guilty plea to two counts of receiving stolen property was not knowing, voluntary, and intelligent, and violated double jeopardy. Heller claimed the truck and trailer he received were a single unit, thus supporting only one conviction. The motion court denied his claims, and the appellate court affirmed, finding a sufficient factual basis for two counts and that Heller failed to meet his burden to prove a double jeopardy violation.
