Missouri Court of Appeals, Eastern District / Nov 9, 2021
Kathleen M. Vaughn, Appellant, v. Missouri CVS Pharmacy, LLC, and Division of Employment Security, Respondents.
Kathleen M. Vaughn appealed the Labor and Industrial Relations Commission's denial of her unemployment benefits claim. Vaughn, who worked two part-time jobs, was laid off from one and subsequently requested not to be scheduled by her second employer due to COVID-19 concerns. The Commission found her ineligible for benefits because she made herself unavailable for work. The appellate court affirmed the Commission's decision, finding it supported by competent and substantial evidence and that the law was correctly applied.
