T.R.S. appealed the trial court's paternity judgment and the denial of his motion to set aside that judgment, which was entered after a hearing he did not attend. The appellate court found that T.R.S. did not receive proper notice of the trial setting because the clerk mailed the order to an incorrect address, and no further attempts to notify him were made. Therefore, the court reversed the denial of the motion to set aside and remanded the case with instructions to vacate the paternity judgment and allow a hearing on the merits.
