Kenneth Pickens, III vs. State of Missouri
Kenneth Pickens appealed the denial of his amended Rule 29.15 motion for post-conviction relief, which the motion court found was filed out of time. Pickens alleged ineffective assistance of trial and appellate counsel. The appellate court remanded the case, instructing the motion court to determine whether appointed counsel abandoned Pickens and whether the amended motion was timely filed, as the motion court has an independent duty to make such inquiries.
