Missouri Court of Appeals, Southern District / Jun 20, 2019
TIFFANI AUSTIN, Petitioner-Respondent vs. LARRY JARRED, Respondent-Appellant
Larry Jarred appealed a full order of protection entered against him, which found he stalked Tiffani Austin. The appellate court reviewed the trial court's finding that Jarred stalked Austin, which was based on allegations of threats of litigation, repeated Sunshine Law requests, driving by Austin's house, and running her boyfriend's license plates. The court reversed the judgment, holding that the evidence did not support a finding that Jarred's conduct caused a reasonable fear of physical harm, which is a required element for stalking under the Adult Abuse Act.
