Missouri Court of Appeals, Southern District / Apr 1, 2019
STATE OF MISSOURI, Plaintiff-Respondent v. LEANN BANDERMAN
Leann Banderman appealed the denial of her motion to retax costs, challenging the assessment of jail board bills as court costs in her criminal case. The appellate court reversed the trial court's ruling, holding that there is no statutory authority to tax jail board bills as court costs. However, the court affirmed that Banderman was not entitled to a refund for bond money applied to her sentence-based jail board bill, as she remains legally responsible for those costs, but any debt-based jail board bills should be removed and funds re-applied.
