Respondent

The Presiding Judge of the 45th Judicial Circuit appealed the trial court's judgment dismissing her writ of mandamus against Lincoln County, refusing her request for attorney fees, and denying her motion to disqualify the trial judge. The appellate court affirmed the denial of the motion to disqualify the trial judge. However, it reversed the dismissal of the writ of mandamus, holding the County had a non-discretionary duty to pay the Juvenile Officer's attorney from the Circuit Court's budget, and also reversed the denial of attorney fees incurred in the mandamus litigation.
