Little Sisters of the Poor, et al. Missouri Cases

Nursing homes challenged the Missouri Department of Social Services' (DSS) and MO HealthNet Division's (MHD) Medicaid reimbursement rate reduction before the Administrative Hearing Commission (AHC), then sought judicial review in circuit court. The circuit court adopted the AHC's findings and ruled against DSS/MHD. On appeal, the appellate court reversed and remanded, holding that the circuit court improperly treated the matter as judicial review of a contested case because the AHC's decision was merely advisory and did not constitute a final determination of legal rights, duties, or privileges.
