Appellant

Londa L. Sofia and others, daughters of Gladys Walker, appealed the trial court's grant of summary judgment to Mercy Hospital Joplin in their wrongful death action. Mercy Hospital argued the action was time-barred and the § 537.100 savings clause was inapplicable. The appellate court reversed and remanded, holding that the original petition was timely filed, the subsequent amended petition omitting Mercy Hospital constituted a nonsuit, and the second amended petition re-adding Mercy Hospital was filed within the one-year savings period.
