Luke W. Amoroso, Ph.D. vs. Truman State University
Luke Amoroso, a non-tenured Assistant Professor, sued Truman State University for breach of contract and breach of the implied covenant of good faith and fair dealing after his employment was not renewed. The trial court granted summary judgment for the University, finding Amoroso could not establish damages. The appellate court affirmed, holding that Amoroso received his full contractual salary and that the 2020 Code of Policies, which he relied on for ongoing pay and due process, was not properly made part of the summary judgment record. The court also found no error in the timing of the summary judgment ruling, as Amoroso was granted the discovery he requested.
