Missouri Court of Appeals, Eastern District / Nov 3, 2020
Constance Comparato, Appellant, vs. Lyn Flex West, et al., Respondent.
Constance Comparato, a factory worker, appealed the Labor and Industrial Relations Commission's denial of Workers' Compensation benefits for her left shoulder injury. The Commission affirmed the Administrative Law Judge's finding that Comparato failed to prove her injury was caused by her work. On appeal, Comparato argued the Commission erred by forming its own medical opinion, improperly weighing expert testimony, and issuing an award against the overwhelming weight of the evidence. The appellate court affirmed the Commission's decision, finding no error in its weighing of expert testimony and noting Comparato failed to follow the mandatory analytical formula for challenging the award.
