Missouri Court of Appeals, Southern District / Apr 30, 2018
STATE OF MISSOURI, Respondent, vs. MARK A. HARRIS, Appellant.
Mark Harris appealed his bench-tried conviction for misdemeanor stealing by deceit, which arose from his failure to deliver custom furniture to a customer after receiving an upfront payment and providing numerous false excuses. On appeal, Harris challenged the trial court's admission of other-crimes testimony and the sufficiency of the evidence to sustain his conviction. The appellate court affirmed the judgment, finding no abuse of discretion in admitting the testimony to show intent and concluding that sufficient evidence supported the finding of criminal intent.
