Mark Barnaby appealed a judgment in favor of the Riverwood Estates Homeowners Association, which had obtained a permanent injunction against him for violating subdivision covenants regarding trash storage and commercial vehicle parking. The trial court also awarded the Association attorney fees and costs. The Eastern District of the Missouri Court of Appeals affirmed the trial court's judgment, finding the injunction was consistent with the covenants' plain language given Barnaby's chronic non-compliance. The court also upheld the attorney fee award and granted the Association additional attorney fees for the appeal.
