State of Missouri vs. Mark Lindell Martin
Mark Lindell Martin appealed his felony criminal nonsupport conviction following a bench trial, arguing that the State presented insufficient evidence. Martin contended that the total arrearage was not proven to have accrued within the three-year statute of limitations and that the arrearage was not shown to apply solely to the son named in the amended information. The appellate court affirmed the conviction, holding that neither of Martin's asserted requirements were essential elements of the crime of felony nonsupport under the relevant statute.
