Missouri Court of Appeals, Western District / Mar 2, 2021
Mark Rowland and Brenda Rowland vs. Keith A. Quevreaux, Trustee of the Keith A. Quevreaux Revocable Trust U/T/A dated July 23, 2012
Mark and Brenda Rowland appealed the circuit court's summary judgment in favor of the Keith A. Quevreaux Revocable Trust on their claim for reformation of two deeds. The Rowlands sought to reform the deeds to reflect an orally agreed-upon boundary line, which would transfer approximately 0.95 acres of land from the Quevreaux Trust's property to theirs. The appellate court affirmed the summary judgment, holding that the Rowlands lacked standing to reform one deed due to lack of privity with the original grantor and that the grantor could not convey land already transferred. Furthermore, the Rowlands failed to establish a mutual mistake between the grantors and grantees of the deeds.
