Missouri Court of Appeals, Southern District / Apr 30, 2019
STATE OF MISSOURI, Plaintiff-Respondent vs. MARTIN AKEEM DANIEL, Defendant-Appellant
Martin Akeem Daniel appealed his convictions for possession of marijuana with intent to distribute and felony resisting arrest, following a jury trial. He contended the trial court erred by admitting evidence of uncharged misconduct and by failing to grant him allocution before sentencing. The appellate court affirmed the judgment, concluding that the uncharged misconduct claim was unpreserved for appeal and that Daniel failed to demonstrate prejudice from the lack of allocution.
