Mary Anne Sedey vs. Missouri Secretary of State John R. Ashcroft
Mary Anne Sedey challenged the summary statements prepared by the Missouri Secretary of State for sixteen initiative petitions proposing constitutional amendments related to suffrage and elections. Sedey argued the summary statements were intentionally argumentative, insufficient, and unfair. The appellate court affirmed the trial court's judgment regarding the pre-registration and no-fault absentee voting provisions, finding them fair and sufficient. However, the court reversed in part, holding that the summary statements concerning provisional ballots and absentee voter lists contained misrepresentations that rendered them unfair, and ordered those portions to be redrafted.
