Maxwell Barnes was convicted of using a child in a sexual performance and endangering the welfare of a child. On appeal, Barnes challenged the trial court's rulings regarding forensic interviewer testimony and its refusal to answer jury questions during the penalty phase. The appellate court affirmed the convictions, finding that Barnes either acquiesced in or affirmatively waived any objection to the challenged trial court rulings, thus precluding appellate review.
