Sharon Watson, as Trustee, sued Menard, Inc. and the City of Richmond Heights for negligence after her property sustained damage following a failed condemnation attempt and issues with property insurance and deed recording. The trial court dismissed her amended petition for damages. The appellate court affirmed the dismissal, holding that Watson's negligence claims were time-barred because the statute of limitations began to run when the damages were discoverable, which was more than five years before she filed suit.
