Missouri Court of Appeals, Eastern District / Apr 24, 2018
State of Missouri, Respondent, v. Michael A. White, Appellant.
Michael A. White appealed his conviction for third-degree domestic assault following a bench trial, arguing the trial court plainly erred by admitting improper character evidence and evidence of prior bad acts. The appellate court affirmed the conviction. It held that even if the evidence was improperly admitted, it did not result in manifest injustice or a miscarriage of justice, especially given it was a bench trial where the judge is presumed not to be prejudiced by inadmissible evidence.
