Missouri Court of Appeals, Southern District / Aug 4, 2020
STATE OF MISSOURI, Respondent vs. MICHAEL DUANE HANCOCK, Appellant
Michael Duane Hancock was convicted of robbery and weapons crimes after a convenience store robbery. On appeal, Hancock challenged the trial court's exclusion of his voice and gun identification expert testimony. The appellate court affirmed the convictions, finding Hancock's new-trial motion was untimely, thus unpreserved, and even if preserved, the trial court did not abuse its discretion in excluding the expert testimony due to lack of proper foundation and reliability.
