Michael K. Humphrey appealed his conviction for second-degree murder and life sentence. Humphrey had previously been convicted of first-degree murder by a jury, but the State amended the charge to second-degree murder in exchange for his testimony against an accomplice and a recommended sentence of life imprisonment with the possibility of parole. The agreement included a waiver of Humphrey's right to a direct appeal. The appellate court dismissed the appeal, finding that Humphrey voluntarily waived his right to appeal after clarifying the terms of the agreement with his counsel and receiving the benefit of the bargain.
