The Missouri State Conference of the National Association for the Advancement of Colored People and others appealed the trial court's dismissal of their claims against the State of Missouri and the Secretary of State regarding the Voter ID Law. While the appellants did not challenge the substantive basis for dismissal (lack of standing, mootness, or ripeness), they argued the trial court erred by dismissing the claims "with prejudice." The appellate court agreed, holding that dismissals based on justiciability grounds must be "without prejudice" because they do not adjudicate the merits of the case. The court affirmed the substantive dismissal but modified the judgment to be without prejudice.
