Nacha Rene vs. Royal City Bell, LLC, Et al.
Nacha Rene appealed the dismissal with prejudice of her Missouri Human Rights Act (MHRA) claims against her former employer, Royal City Bell, LLC, et al. The trial court had found Rene's petition untimely, believing the 90-day statute of limitations included the right-to-sue letter's issuance date. The appellate court reversed, holding that both section 1.040 and Rule 44.01(a) require excluding the first day when computing the 90-day period, thus making Rene's petition timely.
