State of Missouri vs. Nancy Russell
Nancy Russell appealed her convictions and sentences for four counts of first-degree domestic assault and four counts of armed criminal action. Russell contended the circuit court plainly erred by allowing a treating physician to offer particularized testimony that improperly vouched for the victim's credibility. The appellate court affirmed the convictions, holding that the doctor's testimony, which focused on the developmental ability of a nine-year-old to fabricate a plausible mechanism for injuries, did not improperly vouch for the victim's credibility.
