Missouri Court of Appeals, Eastern District / Oct 2, 2018
Corey Ellington, Respondent, vs. Napleton's Mid-Rivers Motors, et al., Appellants.
Corey Ellington sued Napleton's Mid-Rivers Motors, et al., alleging a violation of Missouri's service letter statute. Defendants moved to compel arbitration, which the trial court denied as to the service letter claim, reasoning it arose after employment termination and was not specifically referenced in the arbitration agreement. The appellate court reversed, holding that the service letter claim fell within the broad scope of the arbitration agreement, which covered claims arising from employment or termination and explicitly survived termination. The case was remanded with directions to compel arbitration and stay proceedings.
