Missouri Court of Appeals, Eastern District / Jun 27, 2023
State of Missouri, Respondent, v. Oscar Garner, Appellant.
Oscar Garner was found guilty of first-degree robbery, armed criminal action, unlawful possession of a firearm, and felony resisting arrest. On appeal, Garner argued the trial court erred by admitting a Ring surveillance video that was disclosed late and by denying his request to replace a juror. The appellate court affirmed the trial court's judgment, finding no abuse of discretion in admitting the video as it was cumulative evidence, and holding that the juror challenge was waived due to lack of contemporaneous objection.
