Kansas City Chrome Shop, Inc. vs. Patsy G. Smith, Personal Representative
Kansas City Chrome Shop, Inc. (KCCS) appealed the circuit court's dismissal of its claim against the estate of Charles Smith for alleged unpaid loans. The circuit court found KCCS lacked statutory authority to make the claim because its corporate articles were forfeited in 1991, and the claim was filed more than three years after dissolution. The appellate court affirmed, holding that under Kansas law, rights acquired during the forfeiture period do not vest upon reinstatement, and any pre-forfeiture right of suit not brought within three years post-forfeiture is disposed of. Consequently, KCCS lacked standing to pursue its claim against the estate.
