Queen Barrett sued her former employer, Mallory Moving & Storage, Inc., for discrimination. This is the second interlocutory appeal from the circuit court's denial of Mallory's motion to compel arbitration. The appellate court affirmed the circuit court's order, finding that Mallory failed to produce any evidence of an arbitration agreement between the parties, thus failing to meet its burden of production.
