Missouri Court of Appeals, Western District / Nov 2, 2021
Quentin Gabbert vs. State of Missouri and Director of the Department of Revenue
Quentin Gabbert's driver's license was revoked by the Director of Revenue, prompting Gabbert to file a petition for review. The trial court entered judgment for Gabbert when the Director failed to appear, and subsequently denied the Director's motion to set aside the judgment, which argued the original judgment was void for lack of proper service. The appellate court reversed the trial court's denial, holding that the original judgment was indeed void because the Director was not properly served, and actual notice does not confer personal jurisdiction.
