Raineri Construction, LLC appealed the trial court's denial of its motion to compel arbitration in a contract dispute with McCann Concrete Products, Inc. The trial court had denied the motion because the contract lacked a notice statement required by Section 435.460, RSMo. The appellate court reversed, holding that Section 435.460 is preempted by the Federal Arbitration Act (FAA) because the contract involved interstate commerce and invoked the FAA. The case was remanded with instructions to compel arbitration.
