Randall Graves, on supervised probation, sought a declaratory judgment that his federal supplemental security income (SSI) was exempt from monthly intervention fees imposed by the Missouri Department of Corrections, Division of Probation and Parole. The circuit court dismissed his petition with prejudice for failure to state a claim. The Supreme Court of Missouri affirmed the dismissal, finding the claim unripe because the Division had not yet compelled payment or taken definitive action, but reversed the dismissal with prejudice, ordering it be without prejudice instead.
