R.F. vs. Mark S. Owen, Platte County Sheriff
R.F. applied for a concealed carry permit, which the Platte County Sheriff denied based on R.F.'s 1991 felony guilty plea, despite its expungement. The trial court ordered the Sheriff to reconsider, finding that an expunged offense cannot be the sole factor for denial. The appellate court affirmed, holding that while an expunged felony is not an automatic disqualifier under section 571.101.2(3), it can still be considered as a factor in determining suitability for a permit.
