State of Missouri vs. Richard Lowell Bjorgo
Richard Bjorgo appealed his convictions for attempted sexual abuse and armed criminal action, as well as a clerical error in his first-degree assault sentence. The appellate court affirmed the sufficiency of the evidence for the attempted sexual abuse and armed criminal action convictions, and found the verdict director adequately stated all elements. However, the court granted Bjorgo's third point, remanding the case to the trial court to correct the written judgment to reflect an oral pronouncement of life imprisonment, rather than life without parole, for the first-degree assault conviction.
