R.M.S. vs. Lafayette County Prosecuting Attorney, Et Al.
R.M.S. appealed the denial of his petition for expungement of a controlled substance conviction (Count I) related to THC, filed after Amendment 3 legalized recreational marijuana and provided for expungement. The trial court had denied expungement for Count I, believing THC was not a "marijuana offense" under Amendment 3, but granted it for a separate marijuana possession charge (Count II). The appellate court affirmed the expungement of Count II but reversed the denial for Count I, holding that possession of marijuana-derived THC qualifies as a "marijuana offense" subject to expungement under Amendment 3.
