Robert J. Branson appealed the denial of his Rule 24.035 motion for post-conviction relief after pleading guilty to child molestation and statutory rape. Branson claimed ineffective assistance of plea counsel for being unprepared for trial and an insufficient factual basis for his class A felony conviction. The appellate court affirmed the motion court's judgment, finding no merit in the ineffective assistance claim and concluding that the factual basis claim was waived because it was not raised in the amended motion.
