Robert L. Henry was convicted of statutory rape and sodomy. On appeal, he challenged the unanimity of jury verdicts, the State's failure to disclose exculpatory evidence (Brady), a speedy trial violation under the UMDDL, and the constitutionality of a statute allowing prosecutors to dismiss and re-file charges. The appellate court reversed and remanded Count IV for a new trial due to plain error in jury instructions, but affirmed the convictions on Counts I, II, and III. It also denied Henry's Brady, speedy trial, and constitutional claims.
