Missouri Court of Appeals, Eastern District / May 7, 2024
State of Missouri, Respondent, vs. Rodrick Fowler, Appellant.
Rodrick Fowler appealed his convictions for first-degree assault of a law enforcement officer, felony resisting arrest, and armed criminal action following a jury trial. He argued the trial court erred by refusing a requested fourth-degree assault instruction and that there was insufficient evidence for the felony resisting arrest conviction. The appellate court affirmed the judgment, holding that the proposed instruction impermissibly deviated from the charged conduct and that defense counsel's admission of guilt waived the sufficiency-of-evidence claim for resisting arrest.
