Rommae Hayes vs. Ginger C, LLC and Treasurer of The State of Missouri, Custodian of The Second Injury Fund
Rommae Hayes appealed the Labor and Industrial Relations Commission's denial of his claim for workers' compensation benefits against Ginger C, LLC. Hayes contended that he was an employee of Ginger C or, alternatively, that a statutory employment relationship existed. The appellate court affirmed the Commission's final award, concluding that the Commission's factual findings, to which the court deferred, supported the determination that Hayes was an independent contractor and that the work performed was not in Ginger C's usual course of business.
