Ronald McLemore appealed his conviction for attempted forcible sodomy in the first degree, arguing there was insufficient evidence that he used forcible compulsion. The victim, an eight-year-old girl, testified that McLemore grabbed her hand and moved it toward his penis before she pulled away. The appellate court affirmed the conviction, holding that under the totality of the circumstances, including McLemore's physical force, age difference, and position of authority, a reasonable juror could find forcible compulsion.
