Missouri Court of Appeals, Southern District / Jun 1, 2018
STATE OF MISSOURI, Plaintiff-Respondent, vs. RYAN GABRIEL SALVADOR, Defendant-Appellant.
Ryan Gabriel Salvador was found guilty of driving while intoxicated following a bench trial and appealed, challenging the admission of a Certificate of Analysis for the breath analyzer as hearsay. The appellate court affirmed the conviction, assuming without deciding that the Certificate was erroneously admitted. However, it found no prejudice because other evidence, the Maintenance Reports, was admitted without objection and sufficiently established the breath analyzer's calibration, rendering the Certificate cumulative.
