Missouri Court of Appeals, Eastern District / Jul 30, 2019
Maral Annayeva, Claimant/Appellant, vs. SAB of the TSD of the City of St. Louis, Employer/Respondent, and Treasurer of Missouri as Custodian of the Second Injury Fund, Respondent.
Maral Annayeva appealed the Labor and Industrial Relations Commission's decision denying her workers' compensation claim. The Commission affirmed an ALJ's finding that Annayeva failed to prove her injury arose out of and in the course of her employment, citing a lack of work-related cause and the incident occurring before she clocked in. The appellate court reversed and remanded, holding that the Commission's credibility finding regarding the hazardous floor condition was unsupported by competent and substantial evidence. The court further found that Annayeva's injury did arise out of and in the course of her employment, as it occurred on the employer's premises due to a work-related hazard while she was reporting for duty.
