Missouri Court of Appeals, Western District / Dec 24, 2024
Salvador Tolentino-Geronimo vs. State of Missouri
Salvador Tolentino-Geronimo appealed the denial of his Rule 29.15 motion for postconviction relief, which alleged ineffective assistance of counsel and a clerical error in his sentencing judgment. The motion court had denied both claims. The appellate court affirmed the denial of the ineffective assistance claim, concluding that trial counsel's strategic decision not to introduce evidence of the victim's father's sexual abuse was reasonable and the rape shield statute applied. However, the court reversed the denial of the nunc pro tunc order, finding the written judgment did not accurately reflect the oral pronouncement of sentence regarding parole eligibility, and remanded for correction.
