Missouri Court of Appeals, Southern District / Aug 9, 2018
STATE OF MISSOURI, Respondent, vs. SHANE ASHLEY RODGERS, Appellant.
Shane Ashley Rodgers appealed his conviction for second-degree domestic assault, arguing the trial court erred in denying his motion for acquittal due to insufficient evidence that he caused physical injury to the victim. Rodgers had forcibly held a pillow over the face of a blood relative who had suffered a stroke, causing her to gasp for air and her face to turn beet red. The appellate court affirmed the conviction, finding the evidence was sufficient for the trial court to conclude Rodgers knowingly caused physical injury.
